Terms and Conditions for Rubbish Collection Queens Park

These Terms and Conditions govern the provision of rubbish and waste collection services by Rubbish Collection Queens Park to residential and commercial customers. By placing a booking with us, you agree to be bound by these Terms and Conditions. Please read them carefully before confirming any service.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means any individual, business or organisation that requests or receives waste collection or related services from Rubbish Collection Queens Park.

Services means any rubbish removal, waste collection, bulky waste clearance, garden waste collection, or related services provided by Rubbish Collection Queens Park.

Waste means any items, materials or substances presented by the Customer for collection and disposal as part of the Services, excluding prohibited or hazardous items as defined by applicable law and these Terms.

Booking means a confirmed request for Services, whether made by telephone, email, online form, or in person, and accepted by us.

2. Scope of Services

Rubbish Collection Queens Park provides non-hazardous waste collection and clearance services for domestic and commercial customers. The specific type, volume and nature of the Services will be agreed at the time of Booking based on the information you provide.

We reserve the right to decline or cancel Services where the Waste is not as described, is unsafe to handle, is prohibited by law, or where access to the collection point is unsuitable or unsafe for our staff or vehicles.

We do not normally collect hazardous, clinical, medical, chemical, liquid, asbestos-containing, pressurised container, or other specialist wastes unless expressly agreed in writing in advance and subject to additional charges and regulatory requirements.

3. Booking Process

3.1 Bookings may be made by telephone, email or through our online enquiry process. A Booking is not confirmed until you receive a clear confirmation from us specifying the agreed date, approximate time window, service description and price estimate or quotation.

3.2 When placing a Booking, you must provide accurate information about:

The type and approximate volume or weight of Waste.

The location, including access details, floor level, parking arrangements and any restrictions.

Any items that may require special handling, such as electrical goods, white goods, or bulky furniture.

3.3 Our quotation or price estimate is based on the information you give. If, upon arrival, the actual Waste or access conditions differ significantly, we may revise the price, adjust the service, or decline to complete the work. Where possible, we will explain any changes before proceeding.

3.4 The Customer is responsible for obtaining any necessary consents or permissions for our vehicles and staff to access the property, including from landlords, managing agents, neighbours or local authorities where relevant.

4. Service Area and Access

4.1 Our core service area is centred on Queens Park and surrounding districts. Availability and pricing for collections outside our usual operating area may differ, and additional travel or congestion charges may apply. These will be discussed with you before confirming any Booking.

4.2 The Customer must ensure safe and reasonable access to the Waste at the agreed collection time. This includes:

Providing accurate directions and entry instructions.

Ensuring that driveways, access roads and entrances are clear and suitable for our vehicles.

Ensuring that common areas, stairways and internal routes are free from obstruction and safe to use.

4.3 If access is restricted, unsafe, or significantly delayed due to circumstances within the Customer’s control, we may charge a call-out or waiting fee or cancel the Booking and apply a cancellation fee as set out below.

5. Pricing and Quotations

5.1 Prices are usually based on the volume and type of Waste collected, the labour required, and any disposal, recycling or specialist processing charges. We may use approximate load sizes, weight bands, or item-based pricing, which will be explained to you at the time of Booking.

5.2 Any quotation given prior to collection is an estimate based on the information supplied. The final price may vary if the Waste is more than described, includes additional items, or requires extra time or labour. We will inform you of any change before proceeding wherever reasonably possible.

5.3 All prices are quoted inclusive or exclusive of VAT as clearly stated at the time of Booking. If VAT is applicable, it will be charged at the prevailing rate.

6. Payments

6.1 Payment is due in full upon completion of the Services unless otherwise agreed in writing in advance. We may require a deposit or full prepayment for certain types of work or for new commercial Customers.

6.2 We accept common methods of payment including cash, bank transfer and major debit or credit cards. Where a payment is made by card, you authorise us to charge the card for the agreed price and any additional fees properly incurred in accordance with these Terms.

6.3 For approved business accounts, invoices will be payable within the credit terms agreed in writing. We reserve the right to charge interest on late payments at the statutory rate and to suspend further Services until all overdue sums are settled.

6.4 If payment is not received when due, we may treat this as a material breach of contract and may take steps to recover outstanding amounts, including reasonable costs of collection and legal fees.

7. Cancellations and Amendments

7.1 You may cancel or amend your Booking by contacting us during normal business hours.

7.2 If you cancel more than 24 hours before the agreed collection time, no cancellation fee will normally apply.

7.3 If you cancel less than 24 hours before the agreed collection time, or if we attend the property and are unable to carry out the Services due to your act, omission or failure to provide access, we may charge a cancellation or call-out fee to cover our costs.

7.4 We will use reasonable endeavours to accommodate any request to reschedule a Booking, subject to availability. Short-notice rescheduling may be treated as a cancellation at our discretion where it causes operational or staffing issues.

7.5 In the event that we need to cancel or reschedule a Booking due to vehicle breakdown, staff illness, extreme weather, safety concerns, or other operational reasons beyond our reasonable control, we will notify you as soon as possible and offer a revised time. We will not be liable for any loss arising from such cancellation or delay, but any deposit paid for the affected Booking will be refundable if we cannot offer a suitable alternative time.

8. Customer Responsibilities

8.1 You are responsible for ensuring that the Waste presented for collection is accurately described and does not contain any prohibited or hazardous materials other than those we have expressly agreed to take.

8.2 You must separate or identify any items that require specific handling or regulatory treatment, such as electrical and electronic equipment, refrigeration units, tyres or items containing liquids, as far as reasonably practicable.

8.3 You must ensure that no sharp, dangerous, or contaminated materials are concealed within bags or containers in a way that could cause harm to our staff. Where such risks are identified, we may refuse to handle the Waste or charge for any additional protective measures required.

8.4 You agree not to present any Waste that is unlawful to transport, store or dispose of under applicable waste management and environmental regulations.

9. Waste Regulations and Disposal

9.1 Rubbish Collection Queens Park operates in accordance with relevant UK waste management legislation and guidance. We aim to maximise reuse and recycling where possible, and to dispose of residual waste responsibly through licensed facilities.

9.2 For commercial Customers, we may require a completed waste transfer note or equivalent documentation. You agree to provide accurate information as required by law for the classification of your Waste.

9.3 Once Waste has been collected and loaded into our vehicle, legal responsibility for that Waste normally transfers to us, provided that it was correctly described and lawfully presented. If it is later found that the Waste included prohibited or misdescribed items, you may remain responsible for any resulting costs, fines or regulatory action.

9.4 We reserve the right to refuse to collect any Waste that we reasonably suspect may breach environmental or waste regulations, or which could pose a risk to health, safety or the environment.

10. Liability and Insurance

10.1 We will carry out the Services with reasonable care and skill. If we damage property as a direct result of our negligence, we will consider claims for repair or compensation, subject to the limitations set out in this section.

10.2 We are not liable for pre-existing damage, fair wear and tear, cosmetic defects, or deterioration resulting from the inherent condition of items being removed. We are also not liable for damage arising from inadequate access, structural weakness, hidden defects, or failure by the Customer to provide accurate information about the premises.

10.3 Our total liability to you in respect of any claim arising out of or in connection with the Services, whether in contract, tort or otherwise, shall not exceed the price paid or payable for the specific Booking in question, except in cases of death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, where our liability is not limited.

10.4 We shall not be liable for any indirect, special or consequential loss, including loss of profits, loss of business, loss of goodwill, or loss of opportunity, whether or not such losses were foreseeable.

10.5 You must notify us in writing of any claim or complaint relating to the Services within a reasonable time and in any event within 14 days of the relevant collection. We may request evidence, photographs or access to inspect alleged damage before assessing any claim.

11. Events Beyond Our Control

11.1 We will not be in breach of these Terms, nor liable for any delay or failure in performing our obligations, where such delay or failure results from events, circumstances or causes beyond our reasonable control. These may include but are not limited to extreme weather, accidents, traffic disruption, strikes, civil unrest, public health emergencies, or failure of utilities.

11.2 Where such events affect our ability to provide the Services, we will contact you as soon as reasonably practicable to arrange an alternative time or solution.

12. Data Protection and Privacy

12.1 We collect and process personal information necessary to manage your Booking, deliver the Services and administer our business. This may include your name, contact details, address, and payment information.

12.2 We will handle your personal information in accordance with applicable data protection law and only use it for legitimate business purposes such as managing your account, processing payments, and improving our services.

12.3 We will not sell your personal data to third parties. We may share limited information with trusted service providers, such as payment processors or waste disposal partners, where necessary to fulfil the Services and comply with legal obligations.

13. Complaints

13.1 If you are dissatisfied with any aspect of the Services, please contact us as soon as possible, providing your name, address, contact details, and details of the issue.

13.2 We will investigate your complaint and aim to respond within a reasonable timeframe. Where a fault is found, we may offer a remedy such as a partial refund, a repeat service, or another appropriate solution, depending on the circumstances.

14. Variations to These Terms

14.1 We may update or amend these Terms and Conditions from time to time. Any changes will take effect when published or otherwise notified and will apply to new Bookings from that date.

14.2 The Terms and Conditions that apply to your Booking are those in force at the time your Booking is confirmed, unless a change is required by law or regulatory authority, in which case the updated provisions may apply to existing Bookings.

15. Severability

15.1 If any provision of these Terms is found by a court or competent authority to be invalid, unlawful or unenforceable, that provision will be severed from the remaining Terms, which will continue to be valid and enforceable to the fullest extent permitted by law.

16. Governing Law and Jurisdiction

16.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of England and Wales.

16.2 You and Rubbish Collection Queens Park agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or the provision of the Services.

17. Entire Agreement

17.1 These Terms and Conditions, together with any written quotation or confirmation of Booking, constitute the entire agreement between you and Rubbish Collection Queens Park in relation to the Services. You acknowledge that you have not relied on any statement, promise or representation that is not expressly set out in these Terms.
